Abstract
The recognition of Patient Rights began with the establishment of the Nuremberg Code in 1947, which was subsequently adopted by the World Medical Assembly (WMA) in the Helsinki Declaration of 1964. In 1973, the American Hospital Association (AHA) released the Patient’s Bill of Rights, which placed greater emphasis on Patient Rights within health services and led to the creation of the Lisbon Declaration in 1981. In Indonesia, Patient Rights were officially introduced with the issuance of the Circular Letter from the Director General of Yanmed No. 2504 in 1997. These rights are now governed by various legal instruments, culminating in Law Number 17 of 2023, along with its implementing regulations found in Government Regulation Number 28 of 2024. The implementation of Patient Rights within the BPJS Kesehatan framework presents its own set of challenges. The impact of dropping the mandatory spending policy in the health sector on the quality of services and the fulfillment of Patient Rights in Indonesia requires further in-depth study.
